Cooperative ZBA

Cooperative ZBA Member Municipalities:

Tug Hill West ZBA: Boylston – Florence – Osceola – Redfield

Tug Hill East ZBA: Constableville – Harrisburg – Montague – Pinckney – Turin

Due to increased interest in the Cooperative ZBA, in January 2025 the Cooperative Board added municipalities and split into two boards.

Because of the size of the communities that are part of the Cooperative ZBAs, it is physically and fiscally difficult to maintain separate Boards of Appeals in each municipality.

Pursuant to Section 284 of NYS Town Law, Section 7-712 of NYS Village Law and Article 5G of NYS General Municipal Law, municipalities can establish a cooperative zoning board of appeals through an inter-municipal agreement.

Each member municipality is allowed to select one representative to be a member on the Cooperative ZBA. This person is appointed by their respective town or village board for a 1 year term.

The Cooperative ZBAs are charged with hearing applications for interpretations and the granting of use and area variances upon application for any of the member municipalities.
